Why smoking is banned on most charters
Scheduled airlines are bound by national smoking bans. Charter flights are run under different rules, and in some countries the law leaves the decision to the operator. In practice the operator's policy is what counts, and almost all say no.
The reasons are practical. Smoke settles into leather, carpets and headliners, and a jet cannot be aired like a car. A cabin that smells of smoke can put an aircraft out of service for cleaning, and the next client may refuse it. Insurers and aircraft owners also prefer to avoid any fire risk on board.
There is also the crew to think of. Pilots and cabin crew work in the cabin for hours at a time, and many operators have a clean-air policy for them. On a small jet the cockpit is only a curtain or a door away from the passengers.
The rules that apply everywhere
Whatever the operator's policy, some rules do not bend. These come from aviation safety regulation and the aircraft's own approvals.
- No smoking in the lavatory, on any aircraft. US regulations prohibit it and also prohibit disabling or destroying a lavatory smoke detector.
- No smoking when the crew says so, including during refuelling, taxi, take-off and landing.
- No smoking while oxygen is in use on board.
- Crew instructions are binding. Ignoring them can end the flight at the nearest airport and bring a fine.

E-cigarettes and vapes
Most operators treat vaping exactly like smoking: not on board. Vapour leaves residue and can set off a smoke detector.
Carrying a vape is a separate question. Under dangerous goods rules, e-cigarettes and their spare lithium batteries must travel in the cabin with you, never in the hold, and must not be charged during the flight. Keep them switched off and protected against accidental activation.
When smoking is allowed
A few aircraft owners do smoke and allow clients to do the same. When that happens, it is the owner's and the operator's decision for that aircraft, written into the trip details, and usually tied to a cleaning fee and sometimes a requirement that the whole cabin agrees. Cigars are refused more often than cigarettes. Expect fewer aircraft to choose from, which can mean a higher price or a less convenient position.
If smoking matters to you, say so when you request the trip. The team asks the operators, and only offers that allow it will say so. Do not assume, and never light up without written agreement; the crew can refuse to continue the flight.
Many private terminals have an outdoor smoking area, so a last cigarette before boarding is usually possible, away from the apron, the aircraft and the fuel.
Cannabis and other substances
Even where cannabis is legal on the ground, it is usually not on an aircraft. In the United States it remains illegal under federal law, which governs aviation, and most countries ban carrying it across borders. Operators refuse it on board, and crossing a border with it can lead to arrest, whatever the rules at home. The same applies to any controlled substance; customs at private terminals check bags as they would at any terminal.
If someone smokes without permission
Smoking on an aircraft that does not allow it is a safety matter, not just a breach of manners. The captain is responsible for the safety of the flight and can divert to the nearest suitable airport, and authorities can fine passengers who ignore crew instructions. The operator can also charge the cost of cleaning and any time the aircraft is out of service.
If a guest in your party is a heavy smoker, plan for it. Nicotine patches, gum or pouches are generally allowed on board, though some operators ask that pouches are not left in the cabin. On long trips, a fuel stop can give a chance to smoke outside the terminal, away from the aircraft and fuel, if the handler allows it.
